In June of 2009 I found myself 3 months behind on my mortgage payments with Wells Fargo Home Mortgage. I am a USMC veteran and US Army National Guard member, so I hold a VA home loan. I was contacted by US Mortgage funding in June being told that they could help obtain a home loan modification with Wells Fargo. I signed a contract and sent USMF $2,500 the same month.
I was instructed to not pay any payments while this process was going on and to use that money to pay off other bills. I did just as they instructed. In August of 2009 a moratorium was issued by Wells Fargo. In October 2009 according to USMF a loan repayment plan was offered; however, I never received notification of this from either USMF or Wells Fargo. Then in January 2010 I was contacted by Wells Fargo and told that I did not qualify for a home loan modification because I had only paid 4 payments on my current mortgage. When I contact Jennifer concerning this, she had no idea of these VA rules. At this time my loan was moving towards a sale date in May. I then contacted the VA after being advised by another veteran and the VA Case worker in Houston was able to negotiate a repayment options with Wells Fargo within three weeks.
I contact Jennifer concerning the contract and requested my $2,500 be returned per our contract. I was ignored for weeks and then received an email from compliance officer, regarding this matter. After threatening action from a lawyer friend of mine, I received a phone call from a gentleman named Jamen. Jamen said that he was a lawyer but didn't work for the company or the customer???? How does that work. He said that USMF was under no obligation to return my money even though they did not fulfill their end of the contract. He later offered a $500 refund hoping that I would just go away.
I have since filled a complaint with the Southeast Florida BBB and the Attorney General of Florida. USMF has unti Monday 5/10/2010 - 5:00pm to respond or I will seek local legal action. This company to date has not performed based on the contract, either with the modification or the refund.
