Scammed - Paul Woods from Roadrunner Repairs kept my deposit and won't return it - no work done

Paul Woods - Roadrunner Repair kept my deposit of $3000. I gave him the deposit on May 21st, 2012 to repair my roof and the repair never happened, deposit not returned. Paul Woods has sent me several texts and voicemails confirming that he is sorry that the roof repairs have never happened and that he will return my deposit and it has never happened. I have told him so many times that I either need my roof repaired or my deposit back. I really don't want to have to take this to court but this is outright wrong. All I receive is excuses. I just want my money back as he has promised several times.January 1, 2013, Paul texted "Happy New Year to you, im sorry to say, again that my roofers have flaked on me so im going to have to get your deposit back to you. Im so sorry this didnt work out and with all your patience you deserve better. They are another 2 weeks out so i will make arrangements to get your deposit back asap i will call you and get it right back to you". Paul at Roadrunner Repairs has still not given me back my deposit.
